Over a period of fifty-five years, Dr Bashir Mallal's progressive editions of Mallal's Criminal Procedure have established an enviable and respected tradition. This Eighth Edition continues Dr Mallal’s aims of providing the legal profession with an authoritative and practical guide to the criminal procedure and practice of both the Superior and Subordinate Courts in Malaysia.
Mallal's Criminal Procedure contains detailed annotations to all the sections of the Criminal Procedure Code. These annotations, supported by relevant authorities, explain and analyse important aspects of criminal procedure as well as provide useful information such as the history of each section and similarities, if any, to the Indian Criminal Procedure Code 1973 and the Singapore Criminal Procedure Code 2010. They facilitate a better understanding of criminal procedure and serve as signposts for further research.
Other important contents of this edition include the Comparative Table and latest statutory amendments to the Criminal Procedure Code which have come into force since the previous edition was published.
Tan Sri James Foong was appointed as Judicial Commissioner in 1990 and elevated to be High Court Bench in 1992. He also served as a High Court Judge at Johor Bahru, Shah Alam, Ipoh, and Kuala Lumpur. He was elevated to the Court of Appeal in 2005 and in 2009 elevated to the Federal Court (Malaysia Supreme Court). As a Federal Court Judge, he was made a Managing Judge of the Civil Division of the High Court at Kuala Lumpur and of the High Court and Subordinate Courts of the State of Penang. He retired from the Malaysian Judiciary on 25 February 2012. Prior to his appointment as Judicial Commissioner in 1990, he was engaged in private legal practice in both criminal and civil law, majoring in insurance law from 1971 to 1990. Tan Sri James currently practises law as a consultant and sits on various boards of directors of company as independent non-executive director. Tan Sri James is also currently the Chairman of the Ombudsman For Financial Services Malaysia.
Soon after her appointments as the Registrar of Companies and the Chief Registrar of the Federal Courts, Tan Sri Zainun Ali was appointed to the Bench as a Judicial Commissioner of the High Court in 1996. Tan Sri Zainun was then elevated to the Court of Appeal in 2006 and on 4 April 2012, she was elevated to the Federal Court Bench. Whilst on the Bench, Tan Sri Zainun was Editor of the Malaysian Judiciary’s Annual Report (Yearbook) for 9 years. She was also Editor of the Malaysian Judicial Journal for 2 years. Tan Sri Zainun was appointed a board member of the Advisory Board of the United Nations Global Judicial Integrity Network since April 2018. Tan Sri Zainun was Chairman of Malaysia Airports Holdings Berhad and sits on the Board of Permodalan Nasional Berhad (PNB). She was recently appointed Deputy Commissioner of the Enforcement Agency Integrity Commission (EAIC).
