Discovery in Canadian Common Law: Practice, Techniques and Strategies

The Honourable Todd L. Archibald, BA, LLB, LLM, CMed, CArb, FCIArb, was a Superior Court Justice from 1999 to 2021. He is currently an Adjunct Professor at Osgoode Hall Law School and was the Co-Director of Osgoode’s part-time Civil LL.M. program. He is also the co-author of the annual Ontario Superior Court Practice (LexisNexis Canada) and the co-author of Regulatory and Corporate Liability: From Due Diligence to Risk Management (Canada Law Book, updated annually) and Discovery in Canadian Common Law: Practice, Techniques and Strategies (LexisNexis Canada, 2017). He is Editor of the national Advocates’ Quarterly (Thomson Reuters) and was the founding editor of The Annual Review of Civil Litigation (2000-2022). He was a former Litigation Partner with Borden & Elliot. He graduated in law from the University of Toronto in 1977 and was called to the Bar of Ontario in 1979. He obtained a Master of Laws from Osgoode Hall Law School in 1985. He has been a member of the Ontario Civil Rules Committee since 2013 until his retirement in May 2021. He received the Ontario Attorney General’s 2015 David Mundell medal for legal scholarship. Mr Archibald has been the president of Archibald Mediation and Arbitration Solutions Inc. since May 1, 2021.

James C. Morton, B.Sc., LL.B., LL.M., C.S., D.S.A., is the principal at Morton Barristers LLP, where he practices civil and commercial litigation and criminal law. He is past President of the Ontario Bar Association, a certified specialist of the Law Society of Upper Canada in the area of Civil Litigation. Mr. Morton is a member of the Bar of Nunavut and has almost 30 years' experience representing aboriginal businesses and individuals. Mr. Morton has extensive trial experience across Canada and has appeared numerous times before the Alberta Court of Appeal. He lectured in the area of evidence and advanced evidence at Osgoode Hall Law School of York University for 20 years and currently lectures in Canadian law at the University of Western Michigan. Mr. Morton has published 18 legal textbooks commencing with Presumption of Innocence (1988) to the most recent Alberta Litigator's Guide to Evidence, 2nd Edition (2018). Mr. Morton has taught Estate Administration at the Law Clerks Institute, and has taught in the areas of Civil Litigation, Professional Responsibility, Bankruptcy and Business Law of the Ontario Bar Admission Course.

Sam R. Sasso is a lawyer at Ricketts Harris LLP whose practice focuses on commercial litigation and insurance coverage matters. Sam graduated in law from Queen's University in 2006 and was called to the bar in 2007. He writes on a wide range of legal topics and frequently speaks before colleagues and students. Sam built two iPad apps, D&O Policies (with Gary Luftspring) and lawyers building apps, both of which are available at the app store.
