Scientific Evidence

Paul C. Giannelli is the Albert J. Weatherhead III & Richard W. Weatherhead Professor of Law Emeritus at Case Western Reserve University. Professor Giannelli has written extensively in the field of evidence and criminal procedure, especially on the topic of scientific evidence. He has published articles in the Columbia, Virginia, Vanderbilt, Wisconsin, Ohio State, Hastings, Cardozo, and Case Western Reserve law reviews, as well as in the Journal of Criminal Law & Criminology (Northwestern University), Criminal Law Bulletin, and the American Criminal Law Review (Georgetown University). He has also published in interdisciplinary journals, such as the International Journal of Clinical & Experimental Hypnosis, the New Biologist, Profiles in DNA, the Journal of Legal Medicine, and the Journal of Forensic Science.

He has authored nine books. Among them are: Understanding Evidence (5th ed. 2018) (Carolina Academic Press/LexisNexis); Cases and Materials on Evidence (7th ed. 2006) (with Broun & Mosteller); Scientific Evidence (6th ed. 2020) (LexisNexis/Matthew Bender) (with Imwinkelried); and Courtroom Criminal Evidence (6th ed. 2016) (Michie/LexisNexis) (with Imwinkelried, Gilligan & Lederer).

Professor Giannelli's work has been cited in hundreds of court opinions and legal articles, including the decisions of the U.S. Supreme Court in United States v. Scheffer (1998); Daubert v. Merrell Dow Pharmaceuticals, Inc. (1993); Hudson v. Palmer (1984); Barefoot v. Estelle (1983). He currently serves as Reporter for the American Bar Association Criminal Justice Standards on Biological Evidence and co-chair for the ABA Ad Hoc Committee on Innocence. In 2019, he was awarded with the 2019 Wigmore Lifetime Achievement Award by the American Association of Law Schools Evidence Section.

Edward J. Imwinkelried is the Edward L. Barrett, Jr. Professor of Law Emeritus at UC Davis School of Law. A nationally recognized expert on subjects such as DNA typing, forensic psychiatry, and laser techniques for fingerprint detection, Professor Imwinkelried is the author of more than 200 books and other publications. He is frequently called upon for advice on privileges and the admissibility of evidence of other crimes, and his treatise Scientific Evidence is considered authoritative. Professor Imwinkelried served as an army lawyer in the XXIV Corps and 196th Light Infantry Brigade in Vietnam in 1971-1972. He went on to become a lecturer on evidence, criminal procedure, crimes and trial advocacy in the Criminal Law Division of the Judge Advocate General's School in Virginia, then a Professor of Law at the University of San Diego and Washington University before coming to UC Davis in 1985. He has also taught as a Visiting Professor at the Ohio State University, the University of Illinois, University of Houston, and University College Dublin.

Andrea L. Roth is a Professor of Law at UC Berkeley School of Law. Roth is a nationally recognized expert on subjects such as forensic DNA typing, DNA databases, and machine-generated proof, as well as criminal law and procedure. Before coming to Berkeley, she was a Thomas Grey teaching fellow at Stanford, and worked for nearly a decade as a trial and appellate public defender in Washington, D.C., litigating forensic evidence issues. Since 2017, she has served on the Legal Resource Committee of the National Institute of Standards and Technology’s Organization of Scientific Area Committees. She was also an appointed member of the Constitution Project's Committee on DNA Collection. Roth has received several teaching awards, including, in 2019, one of four campuswide Berkeley distinguished teaching awards. Roth graduated in 1998 from Yale Law School, where she received the John Currier Gallagher Prize for best presentation in the trial competition. After law school she clerked for Justice Dana Fabe of the Alaska Supreme Court. She holds undergraduate degrees in mathematics and political science from the University of New Mexico.

Jane Campbell Moriarty is the Carol Los Mansmann Chair in Faculty Scholarship and Professor at Duquesne University School of Law, specializing in Evidence, Scientific and Expert Evidence, Neuroscience and Law, and Professional Responsibility. Among her publications are a treatise, Scientific Evidence (6th ed. 2020) (LexisNexis/Matthew Bender); a casebook, Scientific and Expert Evidence (3rd ed. 2020), and many articles in the areas of scientific evidence, judicial decision making, and legal ethics. Her most recent publications are Neuroimaging Evidence in the United States, in LAW AND MIND: AT THE INTERSECTION OF LAW AND THE COGNITIVE SCIENCES (eds. BARTOSZ BROZEK, FRANCIS SHEN, NICOLE VINCENT AND JAAP HAGE, Cambridge University Press, 2020); Deceptively Simple: Framing, Intuition, and Judicial Gatekeeping of Forensic Feature Comparison Method Evidence, 86 FORDHAM L. REV. 1687 (2018); Who Speaks for Neuroscience? Neuroimaging Evidence and Courtroom Expertise, 68 Case Wes. L. Rev. 783 (2018)(with D.D. She is completing a book for NYU PRESS entitled, ARE YOU LYING NOW? NEUROTECHNOLOGY AND LAW (2021).

Valena Elizabeth Beety is Professor of Law at Arizona State University Sandra Day O’Connor College of Law and the Deputy Director of the Academy for Justice, a criminal justice center connecting research with policy reform. Previously, Beety served as a law professor and the Founding Director of the West Virginia Innocence Project at the West Virginia University College of Law. Beety also created and served as the inaugural director of the first Forensic Justice LL.M. degree program in the United States while at WVU Law. Professor Beety has successfully exonerated wrongfully convicted clients based on forensic evidence, obtained presidential grants of clemency for drug offenses, and served as an elected board member of the national Innocence Network, and an appointed commissioner on the West Virginia Governor's Indigent Defense Commission.

Beety’s experiences as a federal prosecutor in Washington, D.C., and as an innocence litigator in Mississippi and West Virginia, shape her research and writing on forensic evidence and wrongful convictions. She is the co-author of the The Wrongful Convictions Reader (2018). She received the WVU College of Law Faculty Scholarship Award in 2016 and her scholarship is published widely, most notably in the Northwestern Law Review, the University of Chicago Law Review Online, the North Carolina Law Review, the Ohio State Law Journal, the Washington Law Review and the Arizona State University Law Journal. Before serving as an Assistant U.S. Attorney for the District of Columbia, Beety clerked for the Honorable Judge Martha Craig Daughtrey of the U.S. Court of Appeals for the Sixth Circuit, and for the Honorable Chief Judge James G. Carr of the Northern District of Ohio. Beety holds a B.A. and J.D. from the University of Chicago.
