Caldwell's Kentucky Form Book

Richard H.C. Clay practices in the areas of complex litigation, pharmaceutical and medical device litigation, appellate practice and administrative law. He has represented corporate clients and individuals in federal and state constitutional issues, defamation actions, business and contract disputes, trade infringements, business interruption and interference, enforcement of non-competition agreements, lender liability actions, breach of fiduciary duty issues, Equal Credit Opportunity Act actions, Fair Credit Reporting Act actions, civil rights actions and will contests. He has tried over 75 jury trials in state and federal court. He is listed in two categories in the Best Lawyers in America: Business Litigation and Personal Injury and Civil Litigation.

Mr. Clay is a graduate of Davidson College and the University of Kentucky College of Law, where he served as managing editor of the Kentucky Law Journal. Valerie M. Marshall is a Senior Associate at Frost Brown Todd LLC in the Firm's Personal Planning and Family Business Department. Ms. Marshall concentrates her practice in estate planning, estate administration and estate litigation. She also represents individual and corporate executors and trustees in addition to the beneficiaries of trusts and estates. Ms. Marshall is licensed to practice law in both Kentucky and Ohio.

John T. McGarvey is a shareholder and chairperson of the executive committee of Morgan & Pottinger, P.S.C. His practice concentrates in the representation of banks and other lenders in litigation, secured transactions and other matters under the Uniform Commercial Code. He is an adjunct professor at the University of Kentucky College of Law teaching secured transactions. He has taught hundreds of seminars on legal issues affecting financial institutions and credit extenders for organizations such as the Banking Law Institute, National Association of Retail Credit Attorneys, Practicing Law Institute, Professional Bank Services, and various other continuing banking and legal education organizations in locations from Boston to Los Angeles. Mr. McGarvey is a member of the American Bar Association's Section of Business Law and the Committees on the Uniform Commercial Code, Commercial Financial Services and Banking Law; and the Subcommittees on Secured Transactions, Loan Workouts, and Banking and Commercial Litigation. He chaired Kentucky¿s drafting committee for Revised Article 9 (Secured Transactions). He is a Commissioner of the National Conference of Commissioners on Uniform State Laws, and a member of The Conference on Consumer Finance.

Elizabeth Ullmer Mendel has been practicing with the law firm of Woodward, Hobson & Fulton, LLP since her graduation magna cum laude from the University of Louisville School of Law in 1982. Her practice focuses on professional liability defense and she is listed in The Best Lawyers in America in the practice area of Legal Malpractice Defense. Ms. Mendel has represented a variety of other professionals, including insurance agents, stock brokers, real estate agents, social workers, psychologists and health care professionals. She also writes insurance coverage opinions and litigates insurance coverage matters. Ms. Mendel is the chair of the firm¿s Tort & Insurance Practice Group.

In addition to her active trial practice, Ms. Mendel specializes in appellate work and has handled appeals involving many different legal issues. She has represented clients in the Kentucky Court of Appeals, Kentucky Supreme Court, Indiana Court of Appeals, the United States Court of Appeals in both the Sixth and Seventh Circuits, and the United States Supreme Court. She is the designated appeals partner at Woodward, Hobson & Fulton and former Chair of the Louisville Bar Association Appellate Section. Ms. Mendel is the immediate past president of the Louisville Bar Foundation.

Loren Prizant joined the Louisville office of Woodward, Hobson & Fulton as an associate in August 2005. Mr. Prizant practices primarily in the area of product liability. Prior to joining Woodward, Hobson & Fulton, Mr. Prizant served as a federal judicial law clerk for Charles R. Simpson III, United States District Court Judge for the Western District of Kentucky.

After graduating with honors from Boston University in 2001, Mr. Prizant attended the Louis D. Brandeis School of Law at the University of Louisville. While attending law school he served as the Student Bar Association's Treasurer (2003-2004) and Social Chair (2002-2003) and was a member of the Moot Court Board and the Law Journal where he published a Best Note Honorable Mention Offsets or Upsets? An Examination of the Role of 42 USC ¿ 407 in Relation to a Bank's Setoff of Social Security Benefits. BLJ Vol. 42, Issue 1. Mr. Prizant also served as Honor Council Chair (2003-2004) and was named Most Outstanding Law School Graduate in 2004.

Bart Rogers is a Member of Frost Brown Todd LLC in the Lexington office of the firm's Personal Planning and Family Business Department. His practice involves probate and trust law, property law and guardianship, as well as individual and family estate planning and administration, with a concentration in estate, gift, generation-skipping and fiduciary income taxes. He also represents individual and corporate executors and trustees in addition to the beneficiaries of estates and trusts.

Helen Bongard is an Attorney at Law & Professor of Legal Studies, Sullivan University. She revised the Family Law unit in Caldwell's Kentucky Form Book, Fifth Edition.

Jason R. Sowards received his bachelors and masters degree in economics from the University of Kentucky and his law degree from the University of Louisville. He became a member of the Kentucky Bar in 2004. After a circuit court clerkship in Bowling Green, Kentucky, he served as Assistant Director and Publications Director for the University of Kentucky's Office of Continuing Legal Education (UK/CLE). In August 2006, he will receive his masters in library and information science from the University of Kentucky and begin his career as a legal reference librarian at Florida Coastal School of Law in Jacksonville, Florida.

Melinda T. Sunderland is an associate of Morgan & Pottinger, P.S.C. Her practice is concentrated in business litigation, creditors rights, and bankruptcy. Ms. Sunderland is a graduate of Transylvania University (2000) and the University of Kentucky College of Law (2003) where she received the Cali Award for Secured Transactions.

She is co-author of Drop-Dead Date for Local Filings, Kentucky Banker Magazine (Oct. 2005) and of Recent Developments Under the Uniform Commercial Code for the 26th Annual Conference on Legal Issues for Financial Institutions. She has been a co-presenter at various seminars including the Lorman Educational Series seminar on AIA Contracts and the Texas Bankers Association seminar on ¿Common Mistakes in UCC Filings¿.

David C. Trimble is a 1982 graduate of the University of Kentucky College of Law, and has been in private practice as a litigator since that time. He is admitted to practice in the Commonwealth of Kentucky, in United States District Courts for the Eastern and Western District of Kentucky, and the United States Court of Appeals for the Sixth Circuit. Mr. Trimble is currently Of Counsel in the Lexington, KY, office of Frost Brown Todd, LLC.

Mr. Trimble's litigation practice covers a wide range or subject matters, including products liability, business and corporate matters, professional malpractice defense, insurance coverage and life insurance-related litigation, and workers' compensation. He represents clients in matters through jury trials, and on appeals, in both state and federal courts, and in administrative agencies.
