Military Court Rules of the United States: Procedure, Citation, Professional Responsibility, Civility, and Judicial Conduct

EUGENE R. FIDELL is a Visiting Lecturer in Law and Senior Research Scholar at Yale Law School and of counsel at the Washington, D.C. firm Feldesman Leifer LLP. He served as a judge advocate in the U.S. Coast Guard and co-founded the National Institute of Military Justice in 1991. He wrote Military Justice: A Very Short Introduction (Oxford 2016) and is a coauthor of Military Justice: Cases and Materials (Carolina Academic Press 4th ed. 2023) and the Guide to the Rules of Practice and Procedure for the United States Court of Appeals for the Armed Forces (Matthew Bender & Co. 23d ed. 2024).

BRITTANY R. WARREN is a senior associate at WilmerHale in Washington, D.C., where her practice focuses on internal investigations, government enforcement actions, and other criminal and enforcement matters. She previously served as a law clerk to Judge Neomi Rao for the U.S. Court of Appeals for the District of Columbia. Before that she served in the U.S. Army JAG Corps as a special victims prosecutor, legal advisor to special operations forces, and general crimes prosecutor.

FRANKLIN D. ROSENBLATT is an Assistant Professor of Law at Mississippi College School of Law. He retired from the U.S. Army as a Lieutenant Colonel in the Judge Advocate General’s Corps, where his last assignment was Deputy Chief of the Trial Defense Service. He clerked for Judge Barbara J. Rothstein, U.S. District Court for the District of Columbia, and currently serves as President of the National Institute of Military Justice, President of the Military Justice Committee of the International Society for Military Law and the Law of War, and a military judge for the Mississippi National Guard Court of Appeals. He is a coauthor of Military Justice: Cases and Materials (Carolina Academic Press 4th ed. 2023) and March to Justice: Global Military Law Landmarks (Occam 2021), and lead editor for this publication.

JOSHUA L. DRATEL is a Fellow at Fordham Law School’s Center on National Security, and a consultant to the John Adams Project of the American Civil Liberties Union and the National Association of Criminal Defense Lawyers, and is co-chair of NACDL’s National Security Committee. He was lead civilian defense counsel in the military commission case of United States v. David M. Hicks. He practices criminal law nationally from his firm Dratel & Lewis in New York.

BRENNER M. FISSELL is Professor of Law at the Maurice A. Deane School of Law at Villanova Law School University. He previously served as appellate defense counsel in the Military Commissions Defense Organization, and law clerk to both Chief Judge Scott Stucky of the U.S. Court of Appeals for the Armed Forces and Judge Jerome Farris of the U.S. Court of Appeals for the Ninth Circuit.

CHRISTOPHER MATHEWS is a retired Lieutenant Colonel in the U.S. Air Force Judge Advocate General’s Corps. He served as a Senior Judge of the U.S. Air Force Court of Criminal Appeals. He recently completed his doctorate in geothermal policy at Reykjavík University in Iceland.

KAREN OWEN is a law clerk for Judge Steven C. Yarbrough of the U.S. District Court in Albuquerque, New Mexico. Previously, Karen served as an Assistant United States Attorney for the District of New Mexico; an associate in the national appellate practice at King & Spalding in Washington, D.C.; and a law clerk for Judges William P. Johnson of the U.S. District Court for the District of New Mexico and Jay S. Bybee of the U.S. Court of Appeals for the Ninth Circuit. In law school, she was the Executive Bluebook Editor of the Yale Law Journal.

JONATHAN F. POTTER is a retired Lieutenant Colonel in the U.S. Army Judge Advocate General’s Corps. He is the Senior Capital Appellate Counsel in the Defense Appellate Division, U.S. Army Legal Services Agency. He is a former Legal Advisor to the Military Commissions Trial Judiciary, and also served as an Assistant United States Attorney in the Northern District of Indiana and a Litigation Attorney with the U.S. Department of Justice.

BENJAMIN K. GRIMES is a retired Lieutenant Colonel in the U.S. Army Judge Advocate General’s Corps. He is former Professor and Vice Chair of the Criminal Law Department at The Judge Advocate General's Legal Center & School. He is a former member of the American Bar Association Standing Committee on Professionalism and is currently the Deputy Director of the Professional Responsibility Advisory Office at the Department of Justice.

PHILIP D. CAVE practices military law around the world. He is a retired Commander in the U.S. Navy Judge Advocate General’s Corps and a Director of the National Institute of Military Justice.

DWIGHT H. SULLIVAN is a Senior Associate Deputy General Counsel, Office of General Counsel, Department of Defense, and a retired Colonel in the U.S. Marine Corps Reserve. He is a former Chief Defense Counsel of the military commission system. He is a coauthor of Military Justice: Cases and Materials (Carolina Academic Press 4th ed. 2023).
