Clients are like snowflakes; no two are ever truly identical. Like our clients, their estate planning should be individualized to fit their needs and circumstances. To best accomplish our client’s goals, both the lawyer and client must be willing to accept and embrace change.
In fact, the essential task of a lawyer is to assist clients in understanding and in coping with change. The legislature has driven this point home to lawyers who are engaged in estate planning and administration. In recent years, major changes have shaped the future of estate planning. In 2010, Congress passed The Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010, the Tax Cuts and Jobs Act of 2017, the Michigan legislature passed and implemented Michigan’s Trust Code, and several technical amendments to the Michigan Trust Code were made in 2011, and amendments to Article V of the Estate and Protected Individuals Code relating to Protection of an Individual Under Disability and his or her property.
In this changing world, it is perilous to present a book containing forms for standard use. The forms in this book, we believe, comply with federal and state law as it exists today. However, the reader must be alert to modifications and even sudden turnabouts in the law. No form in this book has ever been adopted by a person without modification to meet family circumstances, and, while we encourage and recommend modifications, we note that no revision should be made without regard to its impact on the rest of the document.
