Artificial Intelligence and Technology in the Workplace

John Litchfield’s primary practice includes counseling clients on complex labor and employment-related matters, including disability accommodations under Titles I and III of the Americans with Disabilities Act and the Rehabilitation Act, sexual harassment and safe workplace compliance, leave management, restrictive covenants, executive employee terminations, reductions in force, wage and hour compliance, and other state and federal employment laws.

John is a member of the firm’s Labor & Employment, Commercial Litigation, and Family Office Practices. He is also a leader in the firm’s Artificial Intelligence (AI) Task Force and for years has been counseling clients on AI risks and opportunities in employee recruitment, retention, and personnel management.

Mark Neuberger provides A to Z representation of management in all areas of employment law, including general labor and employment guidance and compliance with workplace-related immigration laws. Mark regularly represents clients in the health care, hospitality, manufacturing and not-for-profit industries. Mark represents employers in employment litigation matters before administrative agencies, such as the Equal Employment Opportunity Commission and National Labor Relations Board, arbitration tribunals, as well as state and federal trial and appellate courts. He has extensive experience negotiating collective bargaining agreements with unions. He also negotiates and drafts executive level employment agreements. He has litigated a wide variety of discrimination claims, whistleblower actions, wage payment and Fair Labor Standards Act cases. In addition, Mark drafts and litigates covenants not-to-compete and other employment-related restrictions.

Prior to becoming an attorney, Mark worked for 10 years in the human resources department of a Fortune 100 corporation. Mark’s practical experiences in human resource management aids him counseling clients on the use of AI in employment matters and in drafting policies and procedures on how to use AI in the workplace.

Michael Ryan is a skilled litigator and counselor with significant experience representing clients in prosecuting and defending restrictive covenants, trade secret theft claims, discrimination and retaliation claims, and wage-and-hour matters. He also regularly counsels employers on a wide range of employment matters, including unfair competition and trade secret laws, hiring and firing decisions, EEO and FLSA matters, enforcement of personnel policies, leave issues, accommodations, drug-testing laws, safety regulations, and governmental investigations. Michael enjoys partnering with clients of all sizes, from multinational corporations to local businesses and executives, and has particular experience counseling employers and litigating cases involving oil and gas services and production, industrial, health care, banking, security, safety, chemical, service, and retail.

Michael is a member of the firm's Labor & Employment Practice and is also a leader in the firm's Artificial Intelligence (AI) Task Force. He regularly counsels clients on AI-related risks and opportunities in the workplace, including the use of AI tools in hiring and recruitment, performance management, wage-and-hour compliance, and workplace safety. He also advises employers on the evolving regulatory landscape governing AI in employment decisions and frequently presents on AI and emerging technology topics at seminars and client trainings.
