When this book was originally published, it was the first comprehensive book focused exclusively on franchise litigation. As franchising has continued to proliferate as a method for distributing goods and services, the updated and detailed information in this edition continues to serve as a useful tool for practitioners who represent franchisees and franchisors in the inevitable disputes that arise in this increasingly important type of business relationship.
For those new to the field of franchising, this book is a useful starting place for identifying the basic, recurring issues in franchise litigation. And for both new and experienced practitioners, it provides insights into many of the more difficult and still-emerging issues that are most frequently encountered as disputes between franchisors and franchisee continue to proliferate. This practical guide takes the essence of a franchise dispute and makes the most difficult franchise litigation seem less complex. Topics include:
- Initial pleadings
- Temporary restraining orders and preliminary injunctions
- Discovery
- Class actions
- Motions for summary judgment
- Trials
- Arbitration and mediation, and more
This updated edition of The Franchise Litigation Handbook book provides an impressive combination of scholarly research and practical insights. The legal research offers a valuable reference tool for researching specific legal issues, while the insights from experienced litigators provides the practical nuances on those legal issues that come from literally decades of prosecuting and defending claims asserted by and against franchisees and franchisors.
