Modern Estate Planning

J. Martin Burke earned his J.D. from the University of Montana School of Law and his LL.M in Taxation from New York University. Upon completion of his J.D., Professor Burke clerked for the honorable William J. Jameson, Senior Federal District Judge for the District of Montana. He subsequently practiced with the law firm of Crowley, Haughey, Hanson, Toole and Dietrich in Billings, Montana before joining the law faculty at the University of Montana. Professor Burke served as Dean of the University of Montana School of Law from 1988 to 1993 and continued as a faculty member until June 2012 when he retired from full-time teaching. He also taught as a visiting tax professor at New York University, the University of Florida, and the University of Washington. For many years, Professor Burke was active in the American Bar Association Section on Legal Education serving as Chair of both the Section’s Accreditation Committee and Standards Review Committee and as a member of the Council on Legal Education. Professor Burke continues to be active in the State Bar of Montana serving on its Professionalism Committee. In addition to his work on Modern Estate Planning, Professor Burke is co-author with Professor Michael Friel (University of Florida) of the following books designed for law school use: Taxation of Individual Income, Eleventh Edition, LexisNexis (2015), Understanding Federal Income Taxation, LexisNexis/Carolina Academic Press, Fifth Edition (forthcoming Summer of 2016), and Taxation of Partnerships and Limited Liability Companies, LexisNexis/Carolina Academic Press (forthcoming Summer of 2016).

Michael K. Friel earned his J.D. from Harvard University and his LL.M in Taxation from New York University. He is Professor of Law at the University of Florida College of Law, where he is also the Director of its Graduate Tax Program. He has taught or lectured on tax law at various law schools in the United States and abroad.

Elaine Gagliardi earned her J.D. from the University of Montana School of Law and her LL.M in taxation from New York University. She is a professor of law at the University of Montana School of Law, where she teaches courses in business organizations and estate planning. She also continues to practice in the estate planning area with George Law Offices, Missoula, Montana. She previously practiced with Perkins Coie in Seattle and with Day, Berry & Howard in Hartford, Connecticut. Elaine is past chairperson of the Business, Estates, Trust, Tax and real Estate Section of the State Bar of Montana.
