Climate change issues are a relatively recent addition to the threats to fish, wildlife, and plants considered under the Endangered Species Act (ESA). Both ESA regulations and ESA-related litigation are evolving quickly. Along with providing an overview of pertinent ESA provisions -- including species listing, critical habitat designation, and the Section 7 consultation process -- this pamphlet provides examples of the growing number of lawsuits alleging ESA violations stemming from climate change impacts. It also reports on agency actions taken under the ESA to address climate change.
